Florida law is very simple..

If the repair cost of your car (and this doesnt mean what joe bob your local mechanic/neighbor will do it for.. it means what  a qualified mechanic who will take care of every little bit of damage will do it for)  is over 80% of the cars value.. it MUST be totalled.   This isnt the insurance companies choice.. its the law.

Therefore- if that TOTAL DAMAGE ESTIMATE was over 8000.00 approximately (this is for 100% of the damage cost- not the 70% they are covering).. they car will get a salvage title... whether you like it or not.. there is nothing they can do.   Its a safety issue.

What im confused about is the fact you are going through their insurance... you are required to have collision on your vehicle since its financed.. why arent you going through your carrier to get 100% of the damages covered (or atleast 100% of the value?)  This just doesnt make sense.

Whether a car is repairable or totalled is NOT negiotible.  clearly your car is over the threshold.. theyve accepted liability @ 70%.. and you must take their offer or leave it.  again- its not their choice.. its state law.</description>

Regardless of what percentage they actually pay on your car, it the total cost to repair it is more than the actual cash value of the vehicle, and it&#039;s considered totaled by the insurance company, you WILL be issued a salvage title if you choose to keep the car.  They really don&#039;t need you to agree with their decision, or particularly care if you do or don&#039;t agree.

If you don&#039;t want a car with a salvage title, take the check they are giving you, plus whatever monies you get from selling your car and apply it to something you are more pleased with that won&#039;t have a salvage title.</description>
